It may also strengthen the case for a stand-alone federal heat stress prevention rule, along the lines of those in California and the other states referenced above. In response to the OSHRC ruling, Rep. Judy Chu, (D-CA) introduced the "Asunción Valdivia Heat Illness and Fatality Prevention Act" (H.R. 3668), which now has 75 co-sponsors. It would mandate that OSHA create standards establishing exposure limits that trigger action to protect covered employees from heat-related illness. Additionally, OSHA would set specific requirements for hydration, scheduled and paid rest breaks in shaded or climate-controlled spaces, acclimatization plans, exposure monitoring, employee and supervisor training, hazard notification, an emergency medical response plan, heat-related surveillance, recordkeeping, and procedures for compensating piece-rate workers for required heat-related rest breaks. The bill was named for a worker who died from heatstroke after working for 10 hours straight in 105-degree Fahrenheit temperatures. The National Institute for Occupational Safety & Health (NIOSH) also issued a formal recommendation for a standard and labor and union groups have petitioned the agency for a standard.
