Zeldin vocally opposed climate change legislation while in Congress, and for 2025, targeted EPA rules for elimination include ambient (air quality) standards, regulations on greenhouse gas emissions, and TSCA regulations impacting both public and occupational health. ese changes are all among Project 2025 recommendations. In addition, the Securities and Exchange Commission's (SEC) final rule for ESG (Environmental, Social and Governance) that required large, publicly traded companies to disclose climate action, GHG emissions, and the financial impacts of severe weather events was set to go into effect in 2026 but implementation has been delayed due to lawsuits. e ESG rule is now unlikely to survive SCOTUS due to the demise of "Chevron Deference" following the high court's June 2024 (6–3) decision in Loper Bright, which reversed over 40 years of administrative law precedents. Other SCOTUS cases raise questions about OSHA's power to promulgate rules without specific congressional approval (based on the Constitution's nondelegation doctrine) and the Corner Shop decision allows any aggrieved business to challenge longstanding OSHA final rules if their business was not in existence at the time the rule was promulgated. is will potentially be the way to kill many existing rules, even outside the 10–1 regulatory policy described above. It is clear that major changes are on the way, but prudent companies will continue to maintain effecting EHS programs and training, even if OSHA may not come knocking for a while. Safety first!
